DMCA Policy – Reporting Intellectual Property Infringement
Welcome to Godytees.com
At Godytees.com, we respect intellectual property rights and are committed to protecting creators and rights holders. Our platform empowers users to design and sell custom apparel and merchandise. However, we strictly prohibit the use of copyrighted or trademarked materials without proper authorization.
If you believe that your intellectual property has been used on our site without permission, please follow the steps below to submit a formal notice of infringement.
- How to Report Intellectual Property Infringement
In accordance with the Digital Millennium Copyright Act (DMCA), Godytees.com will:
- Remove or disable access to content that we, in good faith, believe infringes on the rights of others;
- Notify the content creator of the claim;
- Take further action against repeat infringers, including account termination.
To report a violation, please send a detailed notice of infringement including the following:
- Description of the work you believe has been infringed, including registration numbers (if available).
- Identification of the infringing content — describe how it uses your work without authorization and where it appears on Godytees.com (include links or screenshots if possible).
- Your contact information: Full name, mailing address, phone number, and email.
- Statement of good faith belief that the use of the material is unauthorized by the rights holder, their agent, or the law.
- Statement under penalty of perjury that the information provided is accurate and you are the rights holder or authorized to act on their behalf.
- Signature (electronic or physical) of the authorized party submitting the claim.
- What Happens After a Valid DMCA Notice is Received
Upon receipt of a valid and complete DMCA notice:
- The identified content will be removed or disabled.
- The user responsible for the content will be notified.
- Repeat violations may result in removal of additional content and permanent suspension from our platform.
- Submitting a Counter-Notice
If you believe content was removed in error, or that you have legal grounds (such as fair use or license) to use the content, you may file a counter-notice. The counter-notice must include:
- Identification of the content that was removed, and its location prior to removal.
- A statement under penalty of perjury that the removal was a mistake or misidentification.
- Your contact information: Full name, mailing address, phone number, and email.
- A statement that you consent to the jurisdiction of the Federal Court in your location (or Godytees.com’s jurisdiction if outside the USA), and that you will accept legal service from the original complainant.
- Your signature (electronic or physical).
Upon receiving your counter-notice, we may share it with the original complainant. If the complainant does not take legal action within 10–14 business days, we may restore the content at our discretion.
Important Note:
Knowingly submitting false or misleading claims under the DMCA is a violation of federal law and may result in liability for damages, including legal fees (see Section 512(f) of the DMCA).
